1. Agreement to Terms

By downloading, installing, or using the Witness camera application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

These Terms constitute a legally binding agreement between you and Witness ("Witness," "we," "us," or "our").

2. Description of Service

Witness is a mobile camera application that allows users to:

• Capture photos and videos with cryptographic verification
• Record timestamp and location data at the moment of capture
• Generate a cryptographic hash that proves the media has not been edited
• Share verified media with others who can confirm its authenticity

The App is provided free of charge for personal, non-commercial use.

3. User Accounts

You may need to create an account to use certain features of the App. You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized use of your account

You must provide accurate and complete information when creating your account and keep this information up to date.

4. Acceptable Use

You agree to use the App only for lawful purposes and in accordance with these Terms. You agree NOT to:

• Use the App to create, store, or share illegal content
• Attempt to circumvent, disable, or interfere with the App's security features
• Reverse engineer, decompile, or disassemble any part of the App
• Use the App to harass, abuse, or harm others
• Misrepresent the verification status of any media
• Use the App for any commercial purpose without our written consent
• Interfere with or disrupt the App or servers connected to the App

5. Your Content

You retain ownership of all photos and videos you capture using the App ("Your Content"). By using the App, you grant us a limited license to process Your Content solely to provide the verification services.

You are solely responsible for Your Content and the consequences of sharing it. You represent that you have the right to capture and share any content you create with the App.

6. Verification and Accuracy

The App provides cryptographic verification that media has not been altered after capture. However:

• Verification confirms the media is unedited, not that the subject matter is truthful or accurate
• Location data depends on your device's GPS accuracy and settings
• Timestamp accuracy depends on your device's clock settings
• We do not guarantee that verification will be accepted as legal evidence in any jurisdiction

You should not rely solely on Witness verification for legal, financial, or other critical purposes without consulting appropriate professionals.

7. Intellectual Property

The App and its original content, features, and functionality are owned by Witness and are protected by international copyright, trademark, and other intellectual property laws.

The Witness name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of Witness. You may not use these marks without our prior written permission.

8. Privacy

Your use of the App is also governed by our Privacy Policy, which describes how we collect, use, and share your information. By using the App, you consent to our collection and use of information as described in the Privacy Policy.

9. Third-Party Services

The App may contain links to or integrate with third-party services (such as social media platforms for sharing). We are not responsible for the content, privacy policies, or practices of any third-party services.

10. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

We do not warrant that:

• The App will be uninterrupted, secure, or error-free
• The results obtained from the App will be accurate or reliable
• Any errors in the App will be corrected

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WITNESS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

• Loss of profits, data, or other intangible losses
• Damages resulting from your use or inability to use the App
• Damages resulting from unauthorized access to your data
• Any other damages arising from your use of the App

Our total liability to you for all claims arising from or related to these Terms or the App shall not exceed the amount you paid to us (if any) in the twelve months preceding the claim.

12. Indemnification

You agree to indemnify and hold harmless Witness and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

• Your use of the App
• Your violation of these Terms
• Your violation of any rights of another party
• Your Content

13. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes by posting the updated Terms in the App or on our website with a new "Last updated" date.

Your continued use of the App after changes become effective constitutes your acceptance of the revised Terms. If you do not agree to the revised Terms, you must stop using the App.

14. Termination

We may terminate or suspend your access to the App immediately, without prior notice, for any reason, including if you breach these Terms.

Upon termination, your right to use the App will cease immediately. Provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, and limitations of liability.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States and the State of California, without regard to its conflict of law provisions.

16. Dispute Resolution

Any disputes arising from these Terms or your use of the App shall first be attempted to be resolved through good-faith negotiation. If negotiation fails, disputes shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.

17. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.

18. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Witness regarding the App and supersede all prior agreements and understandings.
